Privacy policy

Preliminary remark
The General Data Protection Regulation (GDPR) took effect on 25 May 2018 and provides for extended information obligations. In compliance with these rules, we therefore inform you about the data processing we carry out. Please note that these are processing operations that we already carried out in the past.
1. Personal data
Kreuzberger em., Stranimaier, Vogler & Grünauer Rechtsanwälte OG collects, processes and uses your personal data only with your consent, on the basis of your mandate or order for the purposes agreed with you, or where another legal basis in accordance with the GDPR applies, in compliance with data protection and civil law provisions.
We only collect personal data that is necessary for the performance and handling of our legal services or that you have provided to us voluntarily.
Personal data is data containing individual details about personal or factual circumstances, for example name, address, e-mail address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings and biometric data such as fingerprints. Sensitive data, such as health data or data relating to criminal proceedings, may also be included.
2. Access and erasure
As a client, or generally as a data subject, you have – subject to the lawyer’s duty of confidentiality – the right at any time to information about your stored personal data, its origin and recipients and the purpose of the processing, as well as the right to rectification, data portability, objection, restriction of processing and blocking or erasure of incorrect or unlawfully processed data.
Please let us know if your personal data changes.
You have the right to withdraw your consent to the use of your personal data at any time. Requests for access, erasure, rectification, objection and/or data portability (the latter provided this does not involve disproportionate effort) may be sent to our law firm using the contact details given in section 15.
If you believe that our processing of your personal data infringes data protection law or that your data protection rights have been violated in any other way, you may lodge a complaint with the competent supervisory authority. In Austria, this is the Data Protection Authority (Datenschutzbehörde).
3. Data security
Your personal data is protected by appropriate organisational and technical measures, in particular against unauthorised, unlawful or accidental access, processing, loss, use and manipulation. Despite our efforts to maintain an appropriately high standard of care at all times, it cannot be ruled out that information you disclose to us via the internet may be viewed and used by other persons.
Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacking of an e-mail account or telephone, interception of faxes).
4. Use of data
We will not process the data provided to us for purposes other than those covered by the mandate, by your consent or otherwise by a provision in accordance with the GDPR. This excludes use for statistical purposes, provided that the data has been anonymised.
5. Transfer of data to third parties
In order to carry out your mandate, it may also be necessary to pass on your data to third parties (e.g. the opposing party, substitutes, insurers, service providers we use and to whom we provide data, etc.), courts or authorities. Your data is passed on exclusively on the basis of the GDPR, in particular to perform your mandate or on the basis of your prior consent.
We also inform you that, in the course of our legal representation and advice, information relating to the facts and the case is regularly obtained from third parties.
Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not correspond to that in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection, or we take measures to ensure that all recipients have an adequate level of data protection, for which purpose we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).
6. Notification of data breaches
We endeavour to ensure that data breaches are detected at an early stage and, where applicable, reported without delay to you or to the competent supervisory authority, including the categories of data concerned.
7. Retention of data
We will not retain data for longer than is necessary to fulfil our contractual or legal obligations and to defend against any liability claims.
8. Cookies and local storage
This website does not use cookies and does not store any information in your browser (no local storage, no session storage). No analytics or tracking services are used.
The fonts used on this website are loaded from this website’s own server; no connection to third-party servers (such as Google Fonts) is made.
For cookies that Google may set after the map has been loaded, see section 10.
9. Server log files
In order to optimise our website with regard to system performance, user-friendliness and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your internet protocol address (IP address), browser and language settings, operating system, referrer URL, your internet service provider and the date/time.
This data is not combined with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.
10. Google Maps
On our home page and our contact page you can display a map from the Google Maps service. The map is only loaded when you click “Load map”; before that, your browser does not connect to Google.
After the click, your IP address and technical information about your browser in particular are transmitted to Google; Google may set cookies. The provider for users in the European Economic Area is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
The “Directions in Google Maps” link opens Google’s website in a new window. Google is responsible for the data processing there.

11. Contact
If you contact us by e-mail or by phone, the data you provide will be stored by us for the purpose of processing your enquiry and in case of follow-up questions. The stored data is reviewed regularly and data that is no longer required is deleted – but no earlier than 6 months after it was stored.
12. Disclaimer
We have compiled the information provided with the greatest care, but exclude any liability for links, references, third-party publications and all third-party information on our website. The information provided is checked before it is uploaded to our website and is not subsequently checked on a regular basis, so that we may not notice any changes. We are available at any time for questions in this regard and will respond to comments and enquiries by checking them accordingly. Use of our website is at the user’s own risk and responsibility.
13. Copyright
The content of our website is subject to Austrian copyright law. Reproduction, editing etc. and any kind of use outside the limits of copyright law require the consent of the respective rights holder. Downloads, copies etc. are not permitted. If you notice a copyright infringement, please inform us and we will take the necessary measures immediately.
14. Changes
We expressly reserve the right to make changes to the information provided without prior notice.
